COMMISSION TERMS OF SERVICE

You must read and agree to these terms to commission me. Please read over these terms every time you commission in case there have been changes!

1. CREATOR RIGHTS

A. I have the right to deny any commission without providing explicit reason.
B. I have the right to change these terms at any time.
C. I have the right to post my artwork anywhere I choose to promote myself as an artist. A 25% privacy fee will be added if you wish to keep your commission private!

2. USAGE POLICY

Only I and the customer (or current owner of the depicted character(s) ) may use artwork produced for them. Even if you did not commission the artwork you are still required to follow these terms.YOU MAY
A. Post the artwork on any website as long as you properly credit me back to one of my official links.
B. Use the artwork for non-profit reasons. (such as a website banner, on a business card, etc.)
C. Make minor edits to the art, such as changing the background color, adding/removing small details, hue shifting etc. That said, please reach out to me first as I will do small edits at any time!YOU MAY NOT
D. Sell my artwork or use it for profit UNLESS we have discussed and agreed upon commercial rights usage (and corresponding fees) prior to payment.
E. Sell my art as an NFT.
F. Remove watermarks/signatures without my prior permission.
G. Trace my work or claim it as yours.

3. ORDERING

A. Please use the form I provide you for ordering. If you think you made a mistake after submitting please let me know as soon as possible.
B. Due dates or rush orders will incur a fee based on the time window given for completion and project size.

4. PAYMENT

A. I only accept commissions paid upfront and through paypal invoices. I do not offer payment plans. The invoice must be paid within 48 hours of it being issued.
B. You must be the legal holder of the paypal account used to pay. You may not use a friend's or relative's account to pay.

5. PROCESS

A. Time of completion can reach up to 2 months (60 days). Wait time depends on how full my queue is and what placement you are on my queue. You can see my current queue here.
B. I will not change the character if I have already began the commission.
C. I send updates based on the frequency decided by the client when ordering. My queue will always have current progress posted to it.
D. I absolutely encourage the request of changes during the process of the commission, but based on factors individual to the piece I may ask for compensation for time spent making edits. Compensation amount varies and will be quoted specifically to each change.

6. REFUND POLICY

You must wait until the end of the 2 month (60 days) completion time before requesting a refund. I will not administer manual refunds before this point in time. I require 3 business days (excluding weekends) to issue a refund after it has been requested. The refund stages below will be based on what is posted to my public queue - not what is saved in my computer files.
- A commission that has not been started can get a 100% refund.
- A commission at the sketching stage can get a 50% refund.
- A commission at the lining stage can get a 25% refund.
- A commission at the coloring stage or after cannot receive a refund of any amount.If you are dissatisfied with a commission, please tell me! I will do few or small edits anytime after completion.

7. PAYPAL CHARGE-BACK INFORMATION

I offer manual refunds so at no point should a charge-back be issued. Upon issuing a charge-back the client should be able to prove some sort of negligence, neglect, & loss of communication on my part regarding a manual refund. I keep dated logs of all communication between every client and I.If using a charge-back to void my refund policy the following actions will be taken :
- The client's rights to the product in question will be forfeited. The product may be resold or utilized in other ways as compensation.
- The client will be subject to public blacklist to warn fellow freelancers of their charge-back.

TERMS OF DESIGN OWNERSHIP

1. PAYMENT

A. I will only accept payment upfront and through paypal invoices. I do not offer payment plans. You must pay the invoice within 48 hours. I do not offer refunds for premade designs.
B. I will send the un-watermarked and full resolution file only after the invoice is paid.

2. PERMISSIONS

RESELLING / TRADING
A. You may resell the design for however much you please. Be respectful when doing so and take into consideration any art you commissioned and the artist's terms.
B. You may trade the design and accept vouchers at your own discretion.
C. Making different version/species/gender/etc of a character is allowed; but ALL versions of the character must be resold or traded together. You cannot keep one version of the character and sell/trade another. You cannot claim full creator rights to different versions, even if it happens to be your own personal species or similar.EDITING
D. You may edit the design in any way you choose, but you may not claim the edited design as completely your own. Include credit of the original design back to me using any of my official links. Please keep the original design/artwork somewhere accessible.

3. OWNERSHIP

A. You may co-own designs but I will not get involved in disputes involving co-owned characters. Similarly, I will not get involved in "return to previous owner if no longer wanted" disputes.
B. Upon no longer owning one of my designs you forfeit all rights to that character. You may not personally dictate who and who cannot own one of my designs. People can freely trade or sell my designs to whomever they desire.
